Actor David Sparks, also known as Dave Sparks and Heavy D, from the reality TV show Diesel Brothers, has been taken into custody. This goes back to October 2, when a judge from a court in Utah found him in contempt for violating court orders. This has a connection to a lawsuit filed in 2017 against the Diesel Brothers for violating the Clean Air Act.

He was apprehended on October 7, and he has been held in a Salt Lake County jail. Sparks' wife is Ashley Sparks. The couple shares three children. According to Legit Biographies, Dave Sparks and Ashley welcomed their eldest daughter, Charley Mae, in 2017. They welcomed Beau in 2015 and Mack in 2017.

In June 2023, she shared a heartfelt Father’s Day post for Dave Sparks. The post was also about how Dave once helped Charley calm down.

Ashley wrote that Charley felt homesick and anxious while she was busy camping with the girl. When she called her mother, Ashley tried to comfort her but couldn’t calm her down. When Ashley asked if she wanted to talk to her father, Charley felt better. Then, Dave Sparks returned from work, and he talked to her, which made her feel better. In the post, Ashley wrote:

“He always does in these anxious moments of hers. He knows just what to say and just how to act. He has a calming and confident way about him in stressful moments. He puts our kids little minds at ease. I’m grateful that he makes up for where I lack. We love that about him. Happy Father’s Day babe. We love you.”

What we know about Dave Sparks’ 2017 lawsuit and the Judge’s recent order

According to USA Today, the 2017 lawsuit said that the Diesel Brothers made changes to diesel vehicles in Utah that caused them to release over thirty times more pollution than allowed by federal rules, adding to the area’s already bad air quality. In his October 2 order, Judge Robert Shelby wrote:

“The court has exhausted all means short of incarceration to obtain Defendant Sparks’s compliance and therefore must order the U.S. Marshal to take him into custody until he complies.”

Meanwhile, in a statement to USA Today, his attorney, Cole Cannon, said that Dave Sparks anticipates a quick resolution of the matter and hopes that he can get out of jail soon. Cannon further said:

“Mr. Sparks was not arrested for a crime. In fact, no crime has been alleged or charged. The arrest stems from a civil matter regarding some zealous environmentalists seeking collection of attorney’s fees.”

In a YouTube video from August 2025, Dave Sparks said he thought some parts of the 2017 lawsuit were unfair, but he also admitted that they did make mistakes when they started their business, like changing trucks in ways that made them produce a lot of smoke. He said he wasn’t proud of those actions.
